(“WOLF’S”), by and through its undersigned counsel, and pursuant to Rule 1.370, Florida Rules of Civil Procedure, responds as follows to Defendant, BROWN + COMPANY ARCHITECTURE, INC. (“BROWN”) Request for Production: GENERAL OBJECTIONS 1. WOLF’S objects to BROWN’s First Request for Production to the extent that it calls for the disclosure and/or production of information and/or documents constituting communications protected by attorney/client privilege, information and/or documents containing attorney work product, and/or information and/or documents that were compiled and/or prepared at the request and direction of counsel in anticipation of, or in connection with, litigation that are protected by the attorney work privilege (including documents within its possession, custody, or control that are responsive to this request, if any, that are the work product of independent experts). 2. WOLF’S objects to BROWN’s First Request for Production, to the extent that it attempts to impose a duty in addition to those duties imposed by the Florida Rules of Civil Procedure. 3. WOLF’S objects to BROWN’s First Request for Production to the extent that it is overbroad, unduly burdensome, and fails to describe the information sought and/or categories of documents to be produced with reasonable particularity. 4. WOLF’S objects to BROWN’s First Request for Production to the extent the definitions and instructions are inconsistent, contradictory, overly broad, burdensome, and/or exceed the requirements of the Florida Rules of Procedure. 3 5. By producing information and/or documents in response to any request for production of documents, WOLF’S does not waive any objections to the admissibility of said information and/or documents at trial. 6. WOLF’S objects to BROWN’s First Request for Production to the extent that it seeks the production of documents at a location and in a manner other than how the documents are kept in the usual course of business. Subject to the foregoing general objections and, where applicable, the specific objections to each request set forth below, WOLF’S provides the following specific responses: DOCUMENTS REQUESTED 1. Any and all contracts you entered into related to the Project. RESPONSE: Subject to the General Objections, above, and without waiving same, WOLF’s will produce all non-privileged documents responsive to this request, if any, at a time and place mutually agreeable to the parties. 2. All documents, drawings, specifications or plans prepared by BROWN that you examined or relied upon in performing your scope of services/work for the project. RESPONSE: Subject to the General Objections, above, and without waiving same, WOLF’s will produce all non-privileged documents responsive to this request, if any, at a time and place mutually agreeable to the parties. 3. All documents memorializing or detailing any inspections performed by BROWN related to your scope of work at the Project. RESPONSE: None in WOLF’s possession. 4 4. All documents memorializing or detailing approvals by BROWN related to your scope of work at the Project. RESPONSE: None in WOLF’s possession. 5. All documents memorializing or detailing work accepted by BROWN related to your scope of work at the Project. RESPONSE: None in WOLF’s possession. 6. All drawings, plans and specifications by BROWN that you allege were improper or non-complaint with the applicable laws, regulations, or building codes. RESPONSE: None in WOLF’s possession. 7. Any improper designs and/or specifications that you relied upon at the Project. RESPONSE: None in WOLF’s possession. 8. All communications between you and BROWN related to the Project. RESPONSE: None in WOLF’s possession. 9. All communications exchanged between you and anyone related to the designs prepared by BROWN for the Project.
