        PREJUDICE AS TO DEFENDANT DON KING’S CONCRETE, INC. ONLY

              Plaintiff      VILLAS     AT     EMERALD         LAKE       HOMEOWNERS

        ASSOCIATION, INC., (“Plaintiff”), by and through undersigned counsel and

        pursuant to Rule 1.250(b) and 1.420(a)(1) of the Florida Rules of Civil Procedure,

        hereby drops and voluntarily dismisses with prejudice all claims the Plaintiff has

        brought against Defendant, DON KING’S CONCRETE, INC., only, with each party

        to bear its own attorneys’ fees and costs. This dismissal shall not affect any claims

        against any other party.
