          PLAINTIFF’S OBJECTION TO AMENDED NOTICE OF NON-PARTY
              PRODUCTION SERVED BY DEFENDANT/CROSS-CLAIM
                        DEFENDANT TGK STUCCO, INC.

              Plaintiff,    VILLAS     AT     EMERALD         LAKE      HOMEOWNERS

        ASSOCIATION, INC. (the “Association”) pursuant to Florida Rule of Civil

        Procedure 1.351(b), hereby objects to the Amended Notice of Non-Party Production

        (“Amended Notice”) served by Defendant/Cross-Claim Defendant, TGK STUCCO,

        INC. (“TGK”) on April 24, 2023, and in support thereof states as follows:

              1.     On April 26, 2023, TGK served the Association with the Amended

        Notice, expressing an intent to seek discovery from the Association’s former

property management companies: Titan HOA Management, LLC and Blue Water

Community Management, LLC (the “Non-Parties”).

      2.     The proposed Subpoenas Duces Tecum Without Deposition were

provided under separate cover. (the “Subpoenas”).

      3.     The Subpoenas directed to the Non-Parties seek 22 categories of

documents.

      4.     Although it is unlikely all of the information in the possession of the

non-parties, if any, is subject to a privilege or otherwise protected from disclosure,

the non-party regularly participated in, received, or transmitted—as agents of the

Association—confidential communications with the Association’s board of

directors, consultants, experts, and/or attorneys.

      5.     As such, the non-parties may have privileged—or otherwise

protected—information in their possession, custody, or control.

      6.     Under Florida law, the Association has the right to prevent any other

person from disclosing the contents of confidential communications in the

possession of the non-party. Las Olas River House Condo. Ass’n, Inc. v. Lorh, LLC,

181 So. 3d 556 (Fla. 4th DCA 2015) (reversible error to order production of records

from management company without in camera review for privileged records).

      7.     Accordingly, the Association objects to the Subpoenas, insofar as:

                a. The Subpoenas are overbroad; and

                b. The Subpoenas seek confidential information, including
                   information protected by the attorney-client privilege and/or
                   work-product doctrine.
      WHEREFORE, the Association respectfully seeks an order barring the

issuance of the Subpoenas unless and until appropriate safeguards are put in place

for the Association to preserve its privileged and confidential information.
