Defendant/Crossclaim Defendant, TGK STUCCO, INC. (“TGK”), by and
through undersigned counsel, moves this Court, pursuant to Florida Rule of Civil
Procedure 1.510, for a partial summary judgment on the Violation of Florida
Building Code claims asserted by Plaintiff, Villas at Emerald Lake Homeowners
Association, Inc. (“Association” or “Plaintiff”), (Count XX) and Defendant/Cross-
Claimant Royal Oak Homes, LLC (“ROH”) (Count Nineteen).
STATEMENT OF UNDISPUTED MATERIAL FACTS
Emerald Lake is a townhome community located in Kissimmee, Osceola
County, Florida. There are 12 two-story townhome buildings containing 88
individual townhomes and common area amenities in Emerald Lake built in 2008,
and between 2015 and 2017. (Deposition of Felix Martin, June 15, 2021, 35:21-25,
36:1-15, Ex. 6, p. 3 1).
Ten (10) buildings (76 townhomes) were built by ROH subcontractors
between 2015 and 2017. Id. Royal Oak served as the general contractor for these
ten townhome buildings.
All homes were built with appropriate permits and Certificates of Occupancy
were issued. (Exh. A to Plaintiff’s motion for summary judgment)
The Association is a non-profit corporation organized and existing to govern
the operation and maintenance of Emerald Lake pursuant to Chapter 720 of the

Florida Statutes and the Declaration of Covenants, Conditions and Restrictions for
the Association. (See Second Am. Compl. ¶¶ 10-11; Fla. Stat. § 720.303(1)).
Plaintiff’s expert, Felix Martin, an engineer, performed visual inspections
and limited destructive testing at locations or areas among the 76 townhomes in the
ten ROH buildings for the purpose of “looking for the material code violations”
because that was “the only thing that we were essentially focused on.” (Martin Dep.,
Vol. I, 35:21-25, 36:1-15, Ex. 6, pp. 6-8; Vol. V, 699:19-25, 700:1-5).
Mr. Martin opined on alleged code violations in the construction of the stucco
based on his limited inspection. However, while he observed water intrusion on the
interior of the property, he was unable to provide any opinions whether the stucco
application caused any of the damage. (Martin Depo. 195:4-25)
All Mr. Martin can opine with respect to the alleged code violations in the
installation of the stucco at the Emerald Lake townhomes is that, there are
violations, but he is uncertain if they caused any damage. (Martin Depo. 195:4-25)
As a result, with respect to the stucco installed at the Emerald Lake
townhomes, Mr. Martin fails to offer a legally sufficient opinion that the alleged
defect was the proximate cause of any actual damages.
STANDARD OF REVIEW
The court may grant a motion for summary judgment on all or any part of a
civil case if the moving party is entitled to a judgment as a matter of law and if
there is no genuine dispute as to any material issue of fact. Florida Rule of Civil

Procedure 1.510(a). The function of a motion for summary judgment is to test the
sufficiency of the evidence in support of a claim or defense.
As stated in Rule 1.510(a), the trial judge may grant a motion for summary
judgment only on a showing that there is no genuine issue as to any material fact
and that the moving party is entitled to a judgment as a matter of law. The initial
burden of establishing these elements is on the moving party and the trial judge
must draw every possible inference against the moving party and in favor of the
party opposing the motion. Celotex Corp. v. Catrett, 477 U.S. 317, 324 (1986).
However, as the Florida Supreme Court observed in the opinion adopting the new
rule, the initial burden on the moving party under the new rule is “not onerous” and
can be “‘readily discharged with ease.’ See In re Amendments To Florida Rule of
Civil Procedure 1.510, 2021 WL 1684095, *3 (Fla. 2021).
The Florida Supreme Court pointed out that the test for determining the
existence of a genuine issue of material fact in dispute is “whether the evidence is
such that a reasonable jury could return a verdict for the nonmoving party.” Id.
[I]t will no longer be plausible to maintain that the existence of any
competent evidence creating an issue of fact, however credible or incredible,
substantial or trivial, stops the inquiry and precludes summary judgment, so
long as the slightest doubt is raised.
Id. (citations omitted)
If the party moving for a summary judgment meets the initial burden of
showing that there is no genuine issue of material fact, the burden shifts to the
party opposing the motion to show that there is a factual dispute that precludes
resolution by summary judgment. This burden can only be satisfied by submitting

sworn testimony or verified documents that contradict the movant's version of the
facts. Conclusions in the pleadings are not sufficient to refute the moving party's
claim that there is no dispute of fact. See Celotex, 477 U.S. at 324. The factual
dispute must be material and genuine. Material facts are those that “might affect
the outcome of the suit under the governing law.” Anderson v. Liberty Lobby, Inc.,
477 U.S. 242, 248 (1986). A mere scintilla of evidence, or evidence that is merely
colorable, is insufficient; it must be “significantly probative.” Id.
ARGUMENT
A. Plaintiff and ROH Cannot Sue Under Section 553.84 for
Building Code Violations that Cause No Actual Damages
Section 553.84, Florida Statutes states:
553.84 Statutory civil action. — Notwithstanding any other
remedies available, any person or party, in an individual capacity or on
behalf of a class of persons or parties, damaged as a result of a
violation of this part or the Florida Building Code has a cause of action
in any court of competent jurisdiction against the person or party who
committed the violation; however, if the person or party obtains
the required building permits and any local government or public
agency with authority to enforce the Florida Building Code
approves the plans, if the construction project passes all required
inspections under the code, and if there is no personal injury or
damage to property other than the property that is the subject
of the permits, plans, and inspections, this section does not apply
unless the person or party knew or should have known that the
violation existed.

First, there must be a Florida Building Code violation. Second, a code
violations, standing alone, are not actionable under Section 553.84. Instead, the
parties must prove that damages causally flowed directly “as a result of a violation”
by TGK of the Florida Building Code.
“Legislative intent is determined primarily from the language of a statute.”
State v. Rife, 789 So. 2d 288, 292 (Fla. 2001) (quoting McLaughlin v. State, 721 So.
2d 1170, 1172 (Fla. 1998)) (“[w]hen construing a statutory provision, legislative
intent is the polestar that guides the Court's inquiry.”). The plain language of
section 553.84 expressly requires a code violation and required damage to property
other than the property that is the subject of the permits.
“According to [Section 553.84’s] express terms, this section does not assume
that damages automatically result from a code violation.” Welcome v. Arvida Cmty.
Sales, Inc., No. 02-01279-CA, 2004 WL 2340249, at *6 (Fla. 4th Cir. Ct. Sept. 13,
2004). The First District Court of Appeal affirmed, without opinion. Welcome, 903
So. 2d 942 (Fla.1st DCA 2005) (unpublished table decision, holding that “a resulting
damage is an essential element to a claim under the statute.” Id. at *5.) Thus,
plaintiff and ROH failed to prove an essential element of this cause of action – i.e.
damages resulting from a claimed violation.
Plaintiff’s expert opined on the existence of alleged construction defects in the
stucco application. However, as he himself testified, he cannot state that the water
infiltration that he observed was a result of any defective application of the stucco.

As a result, TGK is entitled to partial summary judgment in its favor on the
asserted claims under Section 553.84 for these alleged stucco construction defect
matters. Permitting Plaintiff and ROH to proceed with its claims under Section
553.84 would erroneously subject TGK to strict liability for alleged code violations
under Section 553.84, which is not the statutory intent. See Sierra v. Allied Stores
Corp., 538 So. 2d 943, 944 (Fla. 3d DCA 1989) (holding that 553.84 is not a strict
liability statute; see also Grand Union Co. v. Rocker, 454 So. 2d 14, 15-16 (Fla. 3d
DCA 1984) (same)
The plain language of Section 553.84 does not evidence a legislative intent to
create a strict liability statute. Therefore, Plaintiff and ROH must prove, as an
essential element of their claim, that TGK (1) violated a specific provision of the
Building Code, and (2) such violation proximately caused the claimed damages.
They have failed to do so as there is no evidence that any improper application of
the stucco caused damages to the Emerald Lake townhomes.
CONCLUSION
Based on the above, TGK Stucco respectfully requests that this Court enter
partial summary judgment in its favor and against Plaintiff and ROH on their
claims based on Section 553.84 for the alleged defects in the installation of the
stucco Emerald Lake townhome at all 76 townhomes, on the grounds that they
cannot establish the existence of actual damage to property as required by the plain
language of Section 553.84
