Yemma, by and through undersigned counsel and for his cause of action against the Defendants, state accordingly: 1 Plaintiff is the Treasurer of Mahoning County, Ohio and brings this action in his capacity as Mahoning County Treasurer. 2. This action is brought pursuant to R.C. §323.25 and/or §5721.18 of the Ohio Revised Code. 3 The Preliminary Judicial Report prepared in contemplation of this action is attached hereto as Exhibit A in compliance with Rule 13 of the Mahoning County Local Rules of Practice and Procedure. 4 A Master List of Delinquent Vacant Tracts and/or Delinquent Land Tax Certificate has been duly certified by the County Auditor of Mahoning County, Ohio and delivered to the 2024 CV 00698 County Prosecutor of Mahoning County, Ohio for Parcel Number 53-22 1-0-068.00-0, Miltonia Avenue, vacant Lot No. 46374, Youngstown, OH (the “Property”) 5 That more than sixty days has passed since the Mahoning County Auditor delivered a delinquent land duplicate to the Plaintiff regarding the Property. 6. That the real property taxes owed on Parcel Number 53-221-0-068.00-0 were certified delinquent in 2007 and advertised delinquent in 2010. 7. A certified copy of the Delinquent Land Certificate for Parcel Number 53-221-0- 068.00-0 is attached hereto as Exhibit 1 and is incorporated herein. 8 A certified copy of the Auditor’s Tax List and Treasurer’s Duplicate of Real Property for Parcel Number 53-221-0-068.00-0 is attached hereto as Exhibit 2 and is incorporated herein. 9 That more than one year has passed since the taxes on the Property were certified delinquent and the taxes remain unpaid. 10. That the amount of taxes, assessments, charges, penalties and interest (hereinafter referred to as “Impositions”) which remain due and unpaid on the Property are $176.27 and is a first and best lien against said Property which is more fully described in the attached Preliminary Judicial Report (Exhibit A). ll. Plaintiff further says that Defendant Unknown Surviving Spouse, Next of Kin, Devisees, Legatees, Executors, Administrators, and Personal Representatives, if any of Lorenzo Roller, Deceased has or may claim to have some interest in or claim upon the Property, but Plaintiff not being fully advised as to the extent, if any, of such interest or claim, prays that said Defendant be required to set up its interest or claim or be forever barred from asserting same against the within described Property. 2024 CV 00698 12. The Property is delinquent vacant lands as that term is defined in R.C. §5721.01 and/or abandoned lands as that term is defined in R.C. §325.65 and/or nonproductive land as that term is defined in R.C. §5722.01. 13. Plaintiff states that the value of the taxes, assessments, penalties, interest, and all other charges and costs of the action exceed the auditor's fair market value of the Property. 14, Therefore, in accordance with R.C. §323.28 (E) and/or R.C. §5721.19 (1), plaintiff, or on the court's own motion, shall, upon any adjudication of foreclosure, order, without appraisal and without sale, that the fee simple title of the Property be transferred to and vested in an electing subdivision as defined in division (A) of section 5722.01. Further, upon the filing for journalization of the decree of foreclosure, without an appraisal or sale and shall constitute confirmation of the transfer and thereby terminate any further statutory or common law right of redemption. 15. In the alternative, Plaintiff elects to invoke the alternative redemption period set forth in R.C. §323.78, and notice is hereby given that if a municipal corporation, township, county, school district, community development organization, or county land reutilization corporation has requested title to the parcel, then upon adjudication of foreclosure of the property, the court shall order, that the equity of redemption and any statutory or common law right of redemption in the property by its owner shall be forever terminated after the expiration of the alternative redemption period and that the property shall be transferred by deed directly to the requesting municipal corporation, township, county, school district, community development corporation, or county land reutilization corporation without appraisal and without a sale, free and clear of all impositions and any other liens on the property, which shall be deemed forever satisfied and discharged. 16. In the alternative, because the property is nonproductive land, in the event that the property is not directly transferred pursuant to R.C. 323.78, if an electing subdivision selects the 2024 CV 00698 property and the parcel is advertised and offered for sale at one sale, but is not sold for want of a minimum bid, the electing subdivision that selected the nonproductive land shall be deemed to have submitted the winning bid at such sale, and the property will be deemed sold to the electing subdivision for no consideration other than the amounts charged under divisions (E) and (F) of R.C. §5722.03. 17. Plaintiff further states that there is and will be due and payable, and thereby a good and valid first lien, all taxes, assessments, penalties and interest, accruing subsequent to the delivery to the Prosecuting Attorney of the Delinquent Land Tax Certificate by the County Auditor and prior to the date of transfer of the property; that there is also due the sum of One Hundred Seventy-five Dollars, ($175.00) to be taxed as costs for a Preliminary Judicial Report and the sum of Fifty Dollars, ($50.00) to be taxed as costs for a Final Judicial Report; and that there is and will also be due the costs incurred in this proceeding as is deemed proper by the Court. WHEREFORE, Plaintiff prays that the property described herein be foreclosed; that the Defendants be required to set up what, if any, interest they may have in said property, or be forever barred from asserting the same; that upon determination of the amount due for taxes, assessments, penalties, interest, and charges to date of sale or transfer, the Court will order said property to be directly conveyed to a municipal corporation, township, county, school district, community development organization, or county land reutilization corporation or sold by the Sheriff of this county in accord with the statutes of the State of Ohio; that unless the amount found due the Plaintiff together with all costs of this proceeding be tendered to the Plaintiff prior to the conveyance or confirmation of sale, or by the expiration of the alternative right of redemption then the equity of redemption of said parties shall be foreclosed; that in the event the property is ordered 2024 CV 00698 sold the impositions due and owing on the property be declared a valid first and prior lien upon the property and that the impositions and costs be paid first from the proceeds of the sale.
