21 I. INTRODUCTION
22 Defendants Kal Freight Inc. and Pro Tec Inc. (collectively herein, “defendants”) respectfully
23 request that they be permitted to withdraw two admissions to plaintiffs request for admissions, and to
24 serve denials in their place. Defendants previously admitted that plaintiff was (1) an independent
25 contractor of defendants, and (2) not an employee of defendants. At the time of the admissions, the
26 case of California Trucking Ass’n v. Bonta (9th Cir. 2021) 996 F.3d 644-- holding that truck drivers
27 are presumed employees per A.B. 5—was still pending certiorari before the U.S. Supreme
28 Court. However, 0n June 30, 2022, the U.S. Supreme Court denied certiorari in Bonta, which made the
