20 I, Daniel R. Mayer, declare as follows:
21 1. I am an attorney at law duly licensed to practice before the courts of the State of
22 California. I am an associate with the law firm of McNAMARA, AMBACHER, WHEELER,
23 HIRSIG & GRAY, LLP, attorneys for Defendants HARJOBAN KAUR TOOR and BALJIT
24 SINGH TOOR.
25 2. I have personal knowledge of the facts set forth below. As to matters stated upon
26 information and belief, I believe them to be true. If called as a witness, could and would testify
27 competently thereto.
28 3. This matter arises out of an incident that that occurred at approximately 5:58 p.m.
DECLARATION OF DANIEL R. MAYER IN SUPPORT OF DEFENDANTS’ MOTION FOR LEAVE TO
PERFORM A FURTHER INDEPENDENT MEDICAL PHYSICAL EXAMINATION OF PLAINTIFF
1 on November 13, 2021 in the parking structure located at 1151 Galleria Boulevard in Roseville,
2 California. the underlying incident, Plaintiff allegedly sustained a broken left arm from coming
3 into contact with a stop sign. Afterward, he was taken via ambulance to Sutter Roseville Medical
4 Center, where he was under the care of emergency medicine specialist Napoleon Bernardo, M.D.,
5 and underwent surgery with Ryan Vitali, M.D. After being discharged from the hospital, Plaintiff
6 remained under Dr. Vitali’s care for several months, and underwent two further surgeries.
7 4. Plaintiff was initially deposed on March 23, 2023, before he had responded to initial
8 written discovery. At that time, as Defendants did not have the benefit of his discovery responses,
9 their counsel was reliant on his reports of injury which he attributed to the incident in order to

10 conduct a complete examination. Following Plaintiff’s reports, Defendants’ examination

11 regarding injuries and treatment focused on the three areas of injury he identified: his left arm, his
12 left shoulder, and chest. At the conclusion of deposition, he was offered another opportunity to

13 make additional complaints so they could be examined, but he declined except to complain of
14 ongoing pain generally, which he had done initially and had been examined on. A true and correct
15 copy of relevant excerpts from Plaintiff’s deposition transcript is attached hereto as Exhibit “A.”
16 5. Plaintiff responded to written discovery on May 5, 2023. At that time, in response
17 to Form Interrogatory 6.2, he identified the following injuries: “Fracture of radial bone, Left -
18 forearm ORIF bone graft, chronic radiating shoulder pain, left forearm pain, loss of fixation to left
19 ulna.” In response to Form Interrogatory 6.3, his current complaint was of “radiating pain to the
20 shoulder, left forearm.” A true and correct copy of relevant excerpts from Plaintiff’s initial
21 responses to form interrogatories is attached hereto as Exhibit “B.”
22 6. On or about September 12, 2023, Plaintiff was diagnosed by Munish Lal, M.D., a
23 spine and pain management specialist, with complex regional pain syndrome of the left arm.
24 Plaintiff did not disclose this to Dr. Cahill nor make any complaints to Dr. Cahill that were (as far
25 as Dr. Cahill knew) consistent with CRPS or neuropathic pain. As a result of and in order to treat
26 this diagnosis, Dr. Lal implanted Plaintiff with a trial spinal cord stimulator on December 8, 2023,
27 and planned to perform a permanent implantation on February 16, 2024. A true and correct copy
28 of Dr. Lal’s relevant notes from September 12 and December 8, 2023 is attached hereto as Exhibit

2 7. Plaintiff underwent independent medical examination with Defendants’ expert
3 Edward L. Cahill, M.D. on September 27, 2023, Plaintiff complained only of mild pain (rated at
4 0-3/10) in the elbow, with no complaints and full range of motion in the shoulder. A true and
5 correct copy of Dr. Cahill’s report is attached hereto as Exhibit “D.”
6 8. Plaintiff has also added new claims of neck or cervical spine injury or pain in his
7 recent responses to pre-trial discovery. In his amended responses to Form Interrogatories, his
8 response to 6.2 remains the same, but 6.3 is significantly expanded to include neck pain and back
9 pain. A true and correct copy of Plaintiff’s amended or supplemental responses to form

10 interrogatories is attached hereto as Exhibit “E.”

11 9. In response to Defendants’ special interrogatories, set two, which include contention
12 interrogatories pertaining to any possible claim of neck or lower back pain, Plaintiff responds in

13 the affirmative for the former, but in the negative to the latter. In the follow-up interrogatories
14 asking for the facts, witnesses, and documents evidencing those contentions, no specific details
15 are provided. A true and correct copy of relevant excerpts from Defendants’ pre-trial special
16 interrogatories, set two is attached hereto as Exhibit “F.” A true and correct copy of relevant
17 excerpts from Plaintiff’s responses to the special interrogatories, set two is attached hereto as
18 Exhibit “G.”
19 10. In response to two requests for admissions pertaining to imaging evidence of
20 cervical spine injury, Plaintiff stated that he is unable to admit or deny. His corresponding response
21 to Form Interrogatory 17.1 does not provide any specific further information. A true and correct
22 copy of relevant excerpts from Defendants’ pre-trial requests for admissions, set one is attached
23 hereto as Exhibit “H.” True and correct copies of relevant excerpts from Plaintiff’s responses to
24 the requests for admissions, set one and to Form Interrogatory 17.1 are attached hereto as Exhibits
25 “I” and “J.”
26 11. Due to these new claims (see, the concurrently filed Declaration of Scott C. Berta,
27 M.D. ¶2-9, Exs. A-D.) Defendants’ counsel initially demanded, on January 19, 2024, that Plaintiff
28 appear for IME on February 22, 2024, at Dr. Berta’s location in Vacaville, due to an oversight

1 with regard to Plaintiff’s residence, which is in Grass Valley, CA. Plaintiff’s counsel objected to
2 that IME demand, solely on the basis that the location noticed was further than 75 miles from
3 Plaintiff’s residence. True and correct copies of the original demand and objection thereto are
4 attached hereto as Exhibits “K” and “L.”
5 12. Defendants’ counsel corrected the oversight with the amended notice of IME, served
6 on February 2, 2024, for the same date and time, but at Dr. Berta’s location in Davis. Plaintiff
7 objected to this demand, only now on the basis that a further IME may be conducted only upon a
8 finding of good cause by the Court. Defendant submits that Plaintiff has waived this objection.

11 13. Following Plaintiff’s responses to pre-trial discovery and disclosure of expert
12 witnesses, in which Plaintiff disclosed as a retained expert witness the pain management specialist

13 Joshua Prager, M.D., Defendants’ counsel attempted to meet-and-confer on the subject matter of
14 this Motion. These efforts were rebuffed with a bare reference to the code and a statement that Dr.
15 Prager had only been retained due to Dr. Berta’s involvement. As a result, this Motion was
16 necessarily filed. A true and correct copy of the email correspondence evidencing the meet-and-
17 confer on this Motion is attached hereto as Exhibit “O.” A true and correct copy of Plaintiff’s
18 expert disclosure, with attachments removed, is attached hereto as Exhibit “P.”

1 Plaintiff, Daniel Bonilla hereby submits the following responses to Defendants, Harjoban Kaur Toor
2 and Baljit Singh Toor, Form Interrogatories pursuant to California Code of Civil Procedure § 2030.010,
3 et. Seq.
4 PRELIMINARY STATEMENT
5 These responses are made solely for the purpose of this action. Each answer is subject to all
6 objections as to competence, relevance, materiality, propriety, and admissibility, and any and all other
7 objections and grounds which would require the exclusion of any statements contained herein if the
8 interrogatories were asked of, or any statements contained herein were made by, a witness present and
9 testifying in Court, all of which objections and grounds are reserved and may be interposed at the time
10 of trial.
11 Except for explicit facts admitted herein, no incidental or implied admissions are intended
12 hereby. The fact that responding party has answered any interrogatories should not be taken as an
13 admission that responding party accepts or admits the existence of any facts set forth or assumed by

22 preliminary nature and that the full factual basis concerning this matter is yet to be developed with
