hereby appeals to the Appellate Division of the Supreme Court of the
State of New York, Second Judicial Department, from the Decision and
Order of the Honorable Thomas R. Davis, J.S.C., dated February 5, 2024
and entered February 7, 2024 which Decision and Order directed that the
Defendants' D'ARCANGELO & CO., LLP, MICHAEL C. BETROS,
CPA, PFS, and ARLINGTON PROFESSIONAL SUITES, LLC motion
for summary judgment is GRANTED and the complaint is DISMISSED
and this appeal is from each and every part of said Order, as well as
from the whole thereof, as same was made in error and from the
Amended Decision and Order of Hon. Thomas R. Davis dated February
7, 2024 and entered February 7, 2024 which Amended Decision and
Order directed that the Defendants' D'ARCANGELO & CO., LLP, and
MICHAEL C. BETROS, CPA, PFS, motion for summary judgment is
GRANTED and the complaint is DISMISSED as to those Defendants
and this appeal is from each and every part of said Amended Decision
and Order as well as the whole thereof as same was made in error.
