ANTHONY R. FILOSA, an attorney duly admitted to practice law before the
courts of the State of New York, affirms the following under the penalties of perjury.
1. I am a partner of Rosenberg Fortuna & Laitman, LLP, counsel for Plaintiffs
and, as such, I am fully familiar with the facts and circumstances hereinafter set forth. I make this
Affirmation based upon my personal knowledge of the facts set forth herein.
2. On January 12, 2023, I mailed the Notice of Default dated January 12, 2023,
a copy of which is annexed to the Affirmation of Richard J. DiGeronimo dated February 18, 2024
(the “DiGeronimo Affirmation”) 1 as Exhibit G, to the recipients identified on page 1 thereof
addressed to the addresses on page 1 thereof, via certified mail, by depositing a true copy of same
enclosed in a post-paid, properly addressed wrapper, via certified mail, in an official depository
under the exclusive care and custody of the United States Postal Service within the State of New
York. I also emailed a copy thereof to the recipients identified on page 1 thereof on January 12,
2023. See Exhibit G.

3. On April 14, 2023, I mailed the Notice of Default and Notice of
Acceleration dated April 14, 2023, a copy of which is annexed to the DiGeronimo Affirmation as
Exhibit D, to the recipients identified on page 1 thereof addressed to the addresses on page 1
thereof, via Federal Express overnight delivery by depositing a true copy of the same enclosed in
a properly addressed wrapper into the custody of Federal Express for overnight delivery, prior to
the latest time designated by Federal Express for overnight delivery and via certified mail by
depositing a true copy of same enclosed in a post-paid, properly addressed wrapper, via certified
mail, in an official depository under the exclusive care and custody of the United States Postal
Service within the State of New York. I also emailed a copy thereof to the recipients identified on
page 1 thereof on April 14, 2023. See Exhibit D.
4. On April 20, 2023, I mailed the Notice of Default dated April 20, 2023, a
copy of which is annexed to the DiGeronimo Affirmation as Exhibit E, to the recipients identified
on page 1 thereof addressed to the addresses on page 1 thereof, via Federal Express overnight
delivery by depositing a true copy of the same enclosed in a properly addressed wrapper into the
custody of Federal Express for overnight delivery, prior to the latest time designated by Federal
Express for overnight delivery and via certified mail by depositing a true copy of same enclosed
in a post-paid, properly addressed wrapper, via certified mail, in an official depository under the
exclusive care and custody of the United States Postal Service within the State of New York. I
also emailed a copy thereof to the recipients identified on page 1 thereof on April 20, 2023. See
Exhibit E.
