Dear Judge Fineman:
Attached is Plaintiffs’ Proposed Order Recommending Immediate Review of Statement of
Decision for Phase 2 Trial Upon Petition for Extraordinary Writ, for your review and consideration.
Plaintiffs submitted a stipulation and proposed order to the same effect to defense counsel, however Mr.
Montanari declined to so stipulate. Defendant has changed its position. The Court will recall how the
parties and the Court discussed at great length, and agreed, to submit the issues in this case to the Court
of Appeals. (See transcript excerpts and an email from Mr. Montanari; Exhibit A; Exhibit B; Exhibit
C.)
If the Court wishes to discuss the Proposed Order, there is an upcoming Case Management/Trial
Setting Conference on March 12, 2024, or Plaintiffs would be available on an earlier date at the Court’s
convenience.

We have looked at Code of Civil Procedure section 166.1 and a few cases cited on interpreting the
statute. We have the best chance for acceptance if the order makes a determination as a matter of
law. The statute itself specifies that an additional requirement is that appellate resolution may
materially advance the conclusion of the litigation. Attached is our proposed order. We have not
attached our proposed jury instructions but will do so by Monday, October 18, 2021.
Let me know if you agree with this order, wish to make changes or if we should plan on submitting
competing orders on October 19, 2021. Thanks.

·4· ·I'm not -- I don't get where you think that I don't
·5· ·decide this issue of whether the nuisance is continuing
·6· ·or permanent or a combination of both.
·7· · · · · · MR. DANKO:· Because that's not what a jury would
·8· ·decide.· A jury, for example, we would not -- we would
·9· ·not put -- if it were a jury, we would not put an
10· ·interrogatory to the jury, is this nuisance continuing or
11· ·is it permanent.· Rather, the question to the jury, if it
12· ·was a jury question, would be do you find it reasonable
13· ·to characterize -- that's what the case is saying.
14· ·Because if it is, Plaintiffs have an election to make.
15· ·If it is not, there is no election for them to make.
16· · · · · · THE COURT:· Okay.· I disagree.· So the question
17· ·is whether you are bound by the stipulation as confirmed
18· ·in my order that I am going to be the trier of fact for
19· ·that because that's what I understood.
20· · · · · · And I spent a lot of time because when I
21· ·originally made some of my determinations, we were trying
22· ·to figure out a way to get it up to the Court of Appeal
23· ·on a discretionary writ that I was fine with supporting.
24· ·And then the parties decided on this process.· I mean,
25· ·this case should have been sent to -- you know, done a
26· ·long time ago.
27· · · · · · And I was looking through that, the reason. I
28· ·was trying to be helpful, and I think I might stop being

·3· ·was happy, and then life got in the way, and it's taken a
·4· ·lot longer for -- nobody's fault, but it just is.
·5· · · · · · MR. DANKO:· This would help, your Honor.· If
·6· ·your Honor, for example, were to determine that, hey,
·7· ·either as a matter of law or fact, it is not reasonable
·8· ·to characterize this nuisance as one or the other, then
·9· ·without engaging a jury, we have a question that we can
10· ·bring on appeal.
11· · · · · · That's why we stipulated to this procedure.· So
12· ·before we get the jury in here and try damages and so
13· ·forth, we would have presumably a ruling from your Honor,
14· ·which would be something brought up on appeal and save,
15· ·basically, a jury trial.· That's why we stipulated to
16· ·have your Honor decide this issue.
17· · · · · · THE COURT:· So what I see subsumed in there,
18· ·it's whether I find that the standard, whether it's
19· ·reasonable or not because that's -- I haven't focused on
20· ·that argument, that is kind of whether it's reasonable,
21· ·it's permanent.· That's not how I look at the case law.
22· ·Beck isn't one of the cases I focused on.
23· · · · · · But if we're all in agreement that my ruling
24· ·will be whether it's continuing or permanent, and what I
25· ·look at is whether the property's been remediated,
26· ·whether it can be abated, and what the cost to repair is
27· ·versus the diminution in value, then I think we're good
28· ·to go.· That's how I see it, and I don't hear anything
