Dear Mr. Weiss:
Please be advised that our office is in the process of being retained by Stephen D.
Feiman in relation to the above-referenced matter. Mr. Feiman received a Summons and
Notice towards the end of July which was left under his door.
Our elient is not a heir, devisee, nor a distribute of the Estate of Frank V. Allan.
While our client was named as the proposed Executor in the decedent's Last Will and
Testament, due to family illness, he renounced his nomination as Executor. Subsequently,
a Petition for Probate was filed by the nominated Substitute/ Successor Executor, Stanley
E. Esposito, Esq., as named in the Last Will and Testament of Frank V. Allan.
The decedent was not related to Mr. Feiman, thus he cannot be considered a
distributee or an heir. Additionally, Mr. Feiman is not entitled to take anything under the
Will and is not a devisee. A copy of the Last Will and Testament is enclosed herewith.
We would appreciate that Mr. Feiman be removed as a defendant from this action.
In the event that this requested relief cannot be granted, we would appreciate that an
extension of time to answer in the amount of 90 days be granted.
