LOUIS LEVINE hereby affirms:
1. He is one of the Attorneys for the Plaintiff herein and is admitted to practice
before the Courts of this State and makes this affirmation under penalties of perjury, pursuant to
C.P.L.R. Section 2106, for the Plaintiff herein.
2. This action was commenced by the filing of a Summons and Complaint with the
Clerk of this Court on October 12, 2023, and said Summons and Complaint was served on
Defendant, Mary Revoir herein on October 26, 2023.
3. Defendant interposed no answer or appearance to said summons and complaint
and Plaintiff Oswego Co Ambulance & Hearse Serv Inc. d/b/a Menter Ambulance (hereinafter
"Plaintiff") entered a default judgment against the Defendant on December 11, 2023 in the sum
of $3,042.45.
4. That it has now come to the affiant's attention that the Defendant filed Bankruptcy
on December 8, 2023, prior to the judgment being entered on December 11, 2023.
5. That pursuant to the above, your affiant prays for an Order vacati default
judgment entered in favor of Plaintiff Oswego Co Ambulance & Hearse Se c. d/b Menter
Ambulance and against Defendant Mary Revoir and that the Clerk of th ourt be irected to
amend its records accordingly.
