NOTICE IS HEREBY GIVEN, that an action has been commenced and is pending in this
Court upon a Complaint of the above named Plaintiff against the above named Defendants for the
foreclosure of a Mortgage, dated July 23, 2021, executed by Gareth D. Moses, as mortgagors, to
Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Homestead
Funding Corp., its successors and assigns, as mortgagee, to secure the sum of $127,645.00, and
recorded in the Office of the Clerk of the County of Essex on August 04, 2021 at Instrument
#2021-3992. Thereafter, an assignment of Mortgage from Mortgage Electronic Registration
Systems, Inc., as mortgagee, as nominee for Homestead Funding Corp., its successors and assigns
to NewRez LLC D/B/A Shellpoint Mortgage Servicing dated March 9, 2023 and recorded March
9, 2023 in Instrument # 2023-826.
NOTICE IS FURTHER GIVEN, that the mortgaged premises affected by said foreclosure
action, at the time of the commencement of said action and at the time of the filing of this notice,
was situated at 1710 State Route 28N, Minerva, NY 12851, County of Essex, State of New York
at Section 154.15, Block 5, Lot 35.000.

LEGAL DESCRIPTIONS
ALL THAT CERTAIN PIECE OR PARCEL OF LAND, with the buildings thereon, situate, lying and being in the Hamlet of Minerva,
Town of Minerva, County of Essex, State of New York, being part of the premises (now or formerly) owned by Frank and Anna
Kellogg, said part being herein conveyed being more particularly bounded and described as follows:
BEGINNING to survey in the center of the Minerva-Newcomb State Highway (Route 28N) at a point where the lands (now or
formerly) of William Butler and the lands (now or formerly) of John Gallagher and the lands (now or formerly) of Frank and Anna
Kellogg intersect; from
RUNNING THENCE in an Easterly direction at about right angles with said road along the boundary line between the lands (now or
formerly) of Gallagher and LaBar and the lands (now or formerly) owned by Frank Kellogg for a distance of 406.2 feet to an iron bar
for a marker:
THENCE at about right angles running in a Northerly direction to a point marked by n iron bar in the lands of Kellogg; from
THENCE at about right angles running in a Westerly direction to the center of said Minerva-Newcomb State highway (Route 28N);
from
THENCE running in a Southerly direction along the center of the said State Highway for a distance of 107.3 feet to the place or point
of BEGINNING.
The iron bars herein referred to are placed or are to be placed for distances so the land herein conveyed contains exactly one (1) acre of
land and this land is so conveyed is to be a rectangular parcel of land, both sides being parallel.
The improvements thereon being known as 1710 State Route 28N, Minerva, New York - 12851.
