WHEREAS, no party served herein is an infant or incompetent person for whom a
committee has been appointed and no person not a party has an interest in the subject matter of
this action,
IT IS HEREBY STIPULATED AND AGREED, by and between all of the following:
(a) attorney for plaintiff;
(b) attorney(s) for all defendants who have appeared or answered, including those
who have waived all notices;
(c) defendants who have been served with process and have not appeared but whose
time to do so has not expired;
(d) defendants who have appeared in person; and
(e) referee and/or receiver appointed in this action, if applicable.
That the Notice of Pendency of this action filed in the Office of the Clerk of the County
of Oswego on October 24, 2023 may be discontinued without prejudice and without further costs
in favor of any party, any prior acceleration of the repayment of the Loan that is the subject of
this action is hereby revoked, the Loan is hereby deemed deaccelerated, reinstituted as an
Installment Loan and that an order to that effect may be entered herein by any party hereto
without notice.
