Defendant(s). ----------------------------------------------------------------X Plaintiff, PNC Bank, National Association, submits this Statement of Material Facts pursuant to Section 202.8-g of the Uniform Civil Rules for the Supreme Court and the County Court, that it contends there are no genuine issues to be tried. 1. Defendant Kevin Valentine and Jamise Valentine executed and delivered a Note dated November 25, 2003 for the amount of $300,600.00. (Exhibit 1 of Affidavit of Lori Wysong). A copy of the original note endorsed in blank, was attached to the complaint Exhibit C of Affirmation of Melissa M. Loecher. 2. Defendant Kevin Valentine and Jamise Valentine executed a Mortgage dated November 25, 2003 that was recorded at Book 25589 and Page 385 in the Office of the Nassau County Clerk on December 15, 2003. Defendant Kevin Valentine and Jamise Valentine defaulted under the terms of the Note and Mortgage by failing to make the December 01, 2017 and subsequent payments. (Exhibit 4 of Affidavit of Lori Wysong). 4. A RPAPL §1304 90 Day Notice was mailed to Kevin Valentine and Jamise Valentine at 106 Munro Boulevard, Valley Stream, NY 11581 on October 25, 2022 and the 90 Day Notice listed at least five (5) housing counseling agencies. (Exhibit 5 of Affidavit of Lori Wysong). 5. Within three business days of mailing the 90 Day Notice, notice was electronically filed with the Superintendent of Financial Services on October 26, 2022 as required by RPAPL § 1306(2) and confirmation number NYS5776012 was issued. (Exhibit 6 of Affidavit of Lori Wysong). 6. A notice of default dated October 25, 2022 was mailed to Kevin Valentine and Jamise Valentine at 106 Munro Boulevard, Valley Stream, NY 11581.
