SMITELL LLC, SMITELL B-1 LLC and EXTELL DEVELOPMENT COMPANY against
SUNSHINE MF II LLC, is discontinued without prejudice and without costs.
IT IS FURTHER STIPULATED AND AGREED that this stipulation may be executed
in counterparts, a facsimile execution shall be deemed an original, and the stipulation may be filed
with the Court without further notice.
