NYSCEF DOC. NO. 40 RECEIVED NYSCEF: 01/09/2024
SUPREME COURT OF THE STATE OF NEW YORK
COUNTY OF NASSAU
HON. DAWN JIMENEZ
100 Supreme Court Drive
Mineola, NY 11501
COURT NOTICE FOR DISCOVERY CONFERENCES ON
JANUARY 24, 2024
All discovery conferences (status/compliance/certification) before Justice Jimenez will be conducted in person
on Wednesdays at 9:30 AM in the courtroom on the fourth floor. The parties must check in with the part clerk
upon arrival.
Instructions for submitting a discovery stipulation in lieu of appearing:
In lieu of appearing in person, the parties may file a discovery stipulation on NYSCEF. Justice Jimenez
requires that the parties use the Part 24 discovery stipulation form available on the court website
(https://ww2.nycourts.gov/COURTS/10JD/nassau/supreme_directory.shtml). Do not draft your own stipulation.
The deadline for submission of proposed stipulations is January 22, 2024, at 4:00 P M.
NO STIPULATIONS WILL BE ACCEPTED AFTER January 22, 2024, AT
4:00 PM. IF THE STIPULATION IS NOT FILED BY 4:00 PM, YOU MUST
APPEAR IN PERSON FOR THE CONFERENCE.
The proposed stipulation must set forth “on or before” dates for all outstanding discovery, including paper
discovery, depositions, and medical examinations. The parties should include in the stipulation a date to return
for a certification conference. The certification conference may be scheduled on any Wednesday that does not
fall on a federal or state holiday.
If there is a pending discovery motion or the parties are unable to agree on a stipulation in accordance
with the instructions above, the parties must appear in person for the conference.
Proposed stipulations must be e-filed on NYSCEF under the document type “Stipulation – Discovery
(Request to So Order).” All parties must sign the proposed stipulation. There will be no adjournments except
upon a showing of good cause (22 NYCRR 202.10). Any applications for adjournments must be made by email
to judgejimenezremote@nycourts.gov at least two days before the conference. The email must include an
explanation for the requested adjournment.
Instructions when all discovery is complete:
If the parties agree that discovery is complete and notify chambers prior to the conference, a certification order
will be issued and no in-person appearance will be required. Notification must be sent by email with all parties
copied. The email must also indicate whether the parties are interested in participating in a court-referred ADR
program. Details are available on the court website (https://ww2.nycourts.gov/courts/10jd/nassau/ADR.shtml).
For further information, please consult the part rules or call chambers at 516-493-3247.
