1 Boltax, and Paine Schwartz after the November 17, 2023 discovery cut off without altering the trial date.
2 Plaintiffs moved to compel Liberty Mutual, St. Paul, Paine Schwartz Partners, LLC, and Mitchell
Plaintiffs'
3 Pressner to appear at deposition. If motion to compel Paine Schwartz Partners, LLC is granted,
4 then Plaintiffs will be allowed leave to take Paine Schwartz Partners, LLC's deposition after the discovery
5 cutoff. However, at this time, this request is premature as the Court has not ruled on the motion to
6 compel.
7 As to Dan Doebele and Rena Boltax, Plaintiffs argue that "Plaintiffs are confident the issuing
Plaintiffs' attendance."
8 courts will agree with the propriety of action in this regard, and will compel (App.
9 at 2.) However, Plaintiffs have not moved to compel Dan Doebele and Rena Boltax to appear at
10 deposition. It is unclear how the Court will compel attendance. This request is premature.
