NO. 105 RECEIVED NYSCEF: 08/29/2023 Defendant Robert Daly (“Daly”) seeks to seal the Affidavit of Robert Daly, dated as of the date herewith (the “Daly Affidavit”), submitted in connection with the instant Order to Show Cause.1 In this action, Plaintiff asserts claims against Daly under the Child Victims Act. Daly denies all claims. Plaintiff served document requests seeking various documents. Documents responsive to those requests include communications with Daly’s current employer, as well as documents from a confidential proceeding (the “Confidential Documents”). For the reasons set forth in the attached affidavit (the “Daly Affidavit”), the disclosure of the Confidential Documents threatens Daly’s reputation and profession. Daly has agreed to produce the Confidential Documents for litigation purposes only, but Plaintiff has refused to so stipulate. Good cause exists to seal the Daly Affidavit because, in providing support for the request to keep Confidential Documents “for litigation purposes only,” the Daly Affidavit refers to Daly’s place of employment and the place of employment of a family member. The Daly Affidavit discusses the effects that disclosure of the Confidential Documents will have on his family’s standing in the community. See Doe v. Vajpayee, 2021 WL 4776232 (Sup. Ct., N.Y. County 2021) (sealing documents containing defendant’s name based on potential harm to family and reputational damage). The Daly Affidavit should also be sealed because it refers to a confidential proceeding. Accordingly, Daly respectfully requests that the Daly Affidavit be sealed. 1 On January 26, 2023, Daly moved for the entry of a protective order. While the parties largely agreed on the text of a protective order, Plaintiff insisted that the protective order allow her counsel to take documents produced in this matter and use them in the J.A. matter, which is also pending against co- defendant Lawrence Woodmere Academy. The Court denied the motion.
