The defendants, THE VILLAGE OF ROCKVILLE CENTRE and MICHAEL E.
OSWALD, by their attorneys HAMMILL, CROUTIER, PENDER, KOEHLER, LAWLESS &
MOULTON, P.C., as and for their response to the Court’s Preliminary Conference Order,
allege as follows upon information and belief:
1. The defendants are self-insured in the amount of $250,000.00.
2. The defendants are not aware of the identity of any eye and/or notice
witnesses to the subject motor vehicle accident, other than the parties to this litigation and
those parties listed on the police accident report.
3. The defendants are not aware of any adverse party statement other than the
transcript of the plaintiffs testimony taken at the 50-h hearing held in this matter, which has
previously been exchanged with the parties to this litigation.
4. Annexed hereto is a google map color photograph of the subject accident
location.
5. Annexed hereto is a copy of the police accident report (MV-104).
6. The defendants have not yet selected an expert witness. At such time that
defendants select an expert witness, disclosure will be provided pursuant to CPLR §
3101(d).
