AFFIDAVIT OF PLAINTIFF STATE OF FLORIDA COUNTY OF MARION BEFORE ME, the undersigned authority, personally appeared STEVE LITTLEFIELD as Assistant Vice President of the THE FARMERS NATIONAL BANK OF DANVILLE, a national banking association,(“Affiant”) who, being first duly sworn. deposes and says: I Affiant is more than twenty-one (21) years of age. 22, Affiant is the Assistant Vice President of the Plaintiff in this action and makes this Affidavit upon his personal knowledge of the facts involved. 3. On April 15, 2016, Defendant, VICK] DELYS HYDE (“HYDE”) executed and delivered a Consumer Note (the “Note”) in the original principal amount of ONE HUNDRED SEVEN THOUSAND FOUR HUNDRED and 00/100 DOLLARS ($107.400.00) to Plaintiff. A true and correct copy of the Note is attached to Plaintif! Verified Complaint as Exhibit “A™. 4. HYDE secured the payment and performance of her obligations under the Note by executing and delivering a Mortgage and Security Agreement dated April 15, 2016 (the “Mortgage™) to Plaintiff. A copy of the Mortgage. as recorded on April 20, 2016, in Official Records Book 6378, Page 2. . of the Public Records of Jefferson County, Florida. is attached to Plaintiffs’ Verified Complaint as Exhibit “B”. 5. Plaintiff and HYDE executed a Debt Modification Agreement on June 15, 2016 (the “Modification”), a copy of which is attached to Plaintiffs’ Verified Complaint as Exhibit to Plaintiffs’ Verified Complaint as Exhibit “C”. 6 At the time HYDE executed and delivered the Mortgage in favor of Plaintiff, HYDE owned and intended to encumber the real property described as follows (the “Property™): Lot 2, Block I, HERITAGE HILLS REPLAT, according to the plat thereof a recorded in Plat Book F, Page(s) 129, Public Records of Mai County, Florida. 7, When HYDE executed and delivered the Mortgage in favor of Plaintiff. through inadvertence and clerical error, the Property was erroneously described in the Mortgage as follows: Lot 2, Block 1, HERITAGE HILLS REPLAT, according to the plat thereof as recorded in Plat Book F, Page(s) 129, Public Records of Marion County, Florida, 8 The error in the description of the Property contained in the Mortgage was discovered as the result of a title search in the above styled suit. Nonetheless, it was the intention of the parties that the Mortgage encumber the Property as described in paragraph 4. 9 Plaintiff owns and holds the Note and Mortgage, as modified by the Modification. 10. HYDE defaulted under the Note and Mortgage by failing to timely make the ayment due on September 1, 2017, and thereafter. ll. The sums due Plaintiff under the Note and Mortgage, exclusive of costs, are as follows: THOUSAND NINE a, Principal in the amount of ONE HUNDRED EIGHT ARS ($108,934.60); plus HUNDRED THIRTY-FOUR and 60/100 DOLL per annum from and after through b Interest at the rate of five percent (5 %) THOUSAND NINETY and 81/100 August 31 2020, in the total amount of EIGHTEEN 2020, DOLLARS ($18,090.81); plus per annum, or FOURTEEN and c, Interest at the rate of five percent (5 %) an d after August 31, 2020; plus, 92/100 DOLLARS ($14.92) per day from Late payment fees and other chargs es in the amount of NINETY and 86/100 d DOLLARS (590.86).
