FOR JUDGMENT NOTWITHSTANDING THE VERDICT
After notice and hearing, the Court considered Plaintiffs' Motion to Disregard the
Jury Findings and For Judgment Notwithstanding the Verdict (the “Motion”). The Court
having reviewed the Motion, any response thereto, the evidence before the Court, the
trial record, and the argument of counsel, is of the opinion that the Motion is should be
GRANTED.
IT IS THEREFORE, ORDERED, ADJUDGED and DECREED that Plaintiffs'
Motion to Disregard the Jury Findings and For Judgment Notwithstanding the Verdict is
GRANTED;
IT IS FURTHER ORDERED, ADJUDGED and DECREED that the Jury's Verdict
on Question 1 of the Charge of the Court submitted to the Jury, has no support in the
evidence, and is hereby DISREGARDED;
IT IS FURTHER ORDERED, ADJUDGED and DECREED that the Jury's Verdict
on Question 4 of the Charge of the Court submitted to the Jury, has no support in the
evidence, and is hereby DISREGARDED;
