1 I, Timothy J. Long, declare as follows:
2 1. 1 am an active member ofthe State Bar of California and am authorized to practice
3 before this Court. I am a partner with Orrick, Herrington & Sutcliffe LLP, attorneys of record for
4 Defendant Health Net of California, Inc. ("HNCA"). 1 make this declaration on personal
5 knowledge and, if sworn as a witness, could competently testify to the following facts except
6 where otherwise indicated.
7 2. On December 3, 2018, HNCA deposed Plaintiff Tomas Arana in this matter.
8 Attached hereto as Exhibit A is a true and correct copy of the relevant excerpts of Mr. Arana's
9 deposition testimony.
10 3. On May 2, 2018, Diane Rodes was deposed as a person most knowledgeable for
11 HNCA in this matter. HNCA produced Ms. Rodes as a person most knowledgeable on numerous
12 topics, including ITNCA's meal and rest period policies and procedures applicable to non-exempt
13 employees during the class period, as well as HNCA's policies and procedures set forth in the
14 employee handbooks provided to non-exempt employees. Attached hereto as Exhibit B is a true
15 and correct copy of the relevant excerpts of Ms. Rodes' deposition testimony, including Exhibits
16 15 and 17 to Ms. Rodes' deposition.
