Enclosed please find Plaintiff's Motion for Order to Show Cause for Entry of Final Judgment of Foreclosure pursuant to Florida Statute §702.10. Florida Statute §702.10(1), which addresses the Orders to Show Cause process for residential foreclosures, states "[i]f, upon examination of the court file, the court finds that the complaint is verified, complies with s. 702.015, and alleges a cause of'action to foreclose on real property, the court shall promptly issue an order directed to the other parties named in the action to show cause why a final judgment of foreclosure should not be entered.” Accordingly, my interpretation is that there is no hearing requirement and the Motion can be ruled upon ex-parte. Ihave provided a proposed Order to Show Cause for Entry of Final Judgment of Foreclosure. If this proposed Order meets with your favor, please ensure that a hearing date is inserted in Section 1 of the Order and return a copy of the fully executed Order to all parties utilizing the enclosed stamped envelopes. As an additional courtesy I will ensure that all Defendants properly receive this Order in accordance with Florida Statute §702.10() D@O).
