HOLMES, Defendant/Counter-Plaintiff. _________________________________/ AGREED ORDER RE COUNTER-PLAINTIFF’S MOTION TO COMPEL INTERROGATORY ANSWERS THIS MATTER having come before this Court on October 23, 2023, for hearing on Defendant/Counter-Plaintiff’s Motion to Compel Plaintiff/Counter-Defendant to Answer Interrogatories, upon the agreement between the Parties, and the Court being fully advised in the premises, it is hereby ORDERED AND ADJUDGED that: 1. On October 18, 2022, Defendant/Counter-Plaintiff served a set of interrogatories on Plaintiff/Counter-Defendant. 2. On March 29, 2023, Plaintiff/Counter-Defendant served its responses to interrogatories, raising various general and specific objections. 3. On July 24, 2023, Defendant/Counter-Plaintiff filed a motion to compel better answers to the interrogatories. 4. On October 23, 2023, this Court held a hearing by Zoom to address Defendant/Counter- Plaintiff’s motion. 1 FILED: PALM BEACH COUNTY, FL, JOSEPH ABRUZZO, CLERK, 11/13/2023 03:23:51 PM 5. After overruling Plaintiff/Counter-Defendant’s objections that this Court lacked jurisdiction over the matter because Plaintiff/Counter-Defendant has voluntarily dismissed its claim, the hearing proceeded. 6. This Court allowed the Parties to use a Zoom break out room to confer about the issue. 7. Upon returning to the virtual hearing room, the Parties announced that an agreement had been reached whereby Defendant/Counter-Plaintiff would withdraw its motion to compel at this time with the understanding that Plaintiff/Counter-Defendant will answer interrogatory numbers 5-8 by furnishing responsive records within 15 days of the October 23, 2023, hearing. The Court hereby orders that Plaintiff/Counter-Defendant shall furnish records responsive Defendant/Counter-Plaintiff’s interrogatory numbers 5-8 on or before November 22, 2023. Defendant/Counter-Plaintiff’s motion is denied without prejudice. DONE AND ORDERED in West Palm Beach, Palm Beach County, Florida Copies to: Jeffrey M.
