(hereinafter, “FedEx Freight”), FEDEX 5 CORPORATE SERVICES, INC. (hereinafter, “FedEx Services”), “Defendant”), FEDEX 6 TRADE NETWORKS TRANSPORT AND BROKERAGE, INC. and FEDEX TRADE 7 NETWORKS TRADE SERVICES, LLC (hereinafter collectively, the “FedEx Trade Networks 8 Defendants”). Hereinafter, such defendants shall be referred to collectively as “Defendants”. 9 I. STATUS OF DISCOVERY 10 On June 9, 2023, the Court ordered that Plaintiff may proceed with discovery regarding 11 his individual claims. At this time, the parties have each propounded formal discovery. As of 12 this time, the parties are reviewing each other’s responses to the written discovery requests. After 13 meeting and conferring on Defendants’ discovery responses, the parties agreed to the entry of a 14 protective order for the production of further documents responsive to Plaintiff’s initial discovery 15 requests, including a contract with Cisive, a credit reporting agency that obtained a background 16 check on Plaintiff. On November 15, the Court entered the protective order. The contract was 17 produced. 18 Plaintiff anticipates taking the deposition(s) of Defendants’ Persons Most 19 Knowledgeable regarding the claims in this action following the production of the outstanding 20 discovery, including the contract with Cisive. Defendants took the deposition of Plaintiff on 21 December 14, 2023. Defendants may need to take an additional deposition of a Cisive 22 representative. 23 II. STATUS OF SETTLEMENT OR MEDIATION 24 Plaintiff is amenable to attending private mediation on a class-wide basis. 25 III. ANTICIPATED MOTIONS AND PROPOSED BRIEFING SCHEDULE 26 A. Plaintiff’s Position 27 On June 9, 2023, the Court ordered the stay on discovery to be lifted as to Plaintiff’s 28 individual claims so that Defendant could decide whether to bring a Motion for Summary 1 JOINT CASE MANAGEMENT CONFERENCE STATEMENT 1 Judgment/Adjudication regarding Plaintiff’s individual claims. In the six months since the 2 Court’s order, the parties have propounded discovery as to Plaintiff’s individual claims, and 3 Defendants will take Plaintiff’s deposition within the next two weeks. As such, if Defendants 4 expect to bring a dispositive motion, then a briefing schedule should be set. If Defendants do not 5 intend on filing a dispositive motion, then the Court should lift the stay on class-wide discovery 6 so Plaintiff can propound the necessary discovery to file his motion for class certification. 7 Plaintiff anticipates filing a motion for class certification and potentially a motion for 8 summary judgment. At this time, Plaintiff does not believe it is appropriate to set a briefing 9 schedule for a motion for class certification until Plaintiff has had an opportunity to conduct 10 class-wide discovery. 11 B. Defendants’ Position 12 Defendants will update the Court regarding the change in case posture after Plaintiff’s 13 December 14, 2023, deposition and how to proceed. Defendants still intend on filing a motion 14 regarding Plaintiff’s individual claims in accordance with the Court’s phased discovery plan. 15 Discovery should remain limited to Plaintiff’s individual claims and testimony based on those 16 claims. 17 IV.
