With the above litigation seemingly concluded, a new issue has arisen regarding how to
fairly implement the settlement based upon credits asserted against the sale proceeds. While I
cannot speak for all counsel, I believe that with your assistance the parties can find a better
solution than to litigate anew, but this time over far lesser amounts.
Would you be available for a conference call within the next week to ten (10) days, with
all counsel, to see if motion practice and potentially evidentiary issues can be avoided?
