TO PLAINTIFFS AND TO THEIR ATTORNEYS OF RECORD: AMES 10 Defendant, ALBERT KHERADPOUR, M.D., (“Defendant” or “movant”), submits the following & 11 reply to plaintiffs’ opposition t0 defendant’s motion for protective order regarding plaintiffs’ requests for FESLER 12 admissions, set one and form interrogatories number 17. 1. DeHAAS, 13 I. INTRODUCTION 14 Defendant served a three—page opposition on November 20, 2023. Plaintiff’s “opposition” was JOHNSON, 15 untimely and should be disregarded by this Court. The hearing on defendant’s motion is set for December FOLLETTE, 16 4, 2023. Pursuant t0 Code 0f Civil Procedure section 1005, “A11 papers opposing a motion so noticed 17 shall be filed With the court and a copy served on each party at least nine Lurt days.” (Code of CiV. P. LA 18 § 1005.) Pursuant to Code ofCivil Procedure section 120, calculating time requires counting backwards 19 9“ from the hearing date, excluding the hearing date. Plaintiffs opposition” was due t0 be filed and served 20 on November 17, 2023. As a matter of public record, the Superior Court’s own court date calculator 21 (https://www.lacourt.org/courtdatecalculator/ui/) confirms this calculation. 22 Plaintiffs’ untimely opposition’s sole point for opposing the motion for protective order is that 23 Drs. Abongwa, Collins, and Suterwala have since been dismissed; therefore, the motion is moot because, 24 in plinaitffs opinion, 404 requests for admissions, 1,616 potential responses t0 form interrogatory 25 number 17.1 responses, for a total of 2,020 responses requested from one single defendant is not 26 excessive because it is less than the original demand put upon 4 total defendants that was 1,583 requests 27 for admissions, potential 6,332 responses to form interrogatories for a total of 7,915 responses. 28 /// -2- DEFENDANT’S REPLY IN SUPPORT OF MOTION FOR PROTECTIVE ORDER REGARDING PLAINITFFS’ REQUESTS FOR ADMISSIONS, SETS ONE AND FORM INTERROGATORIES, SET ONE — NO. 17.1
