2. This is a claim for personal injuries by my mother, SHIRLEY
PE7AfAY, all as a resuit of the neglige-«~ of the respondwt in its ownership,
operation, rr~a.''=:—:=.=:-:w, supervision, management and control of the
premises I'M at 70 Malcolm X Boulevard, New York, NY owned and
operated by the respondent.
3. On August 24, 2019, while visiting my mother, SHIRLEY
PETWAY at her residence located at 70 Malcolm X Bou!~~~, Ppt. 2J, New
York, NY, I %88 SINng In the IIVIng room a'I scud apartment when I heard Ny

moeier fall. I ran to her aide and was advised by her that she tripped over
the broken flooring. I imnsported my mother to Harlem Hospital.
4. ShorBy after my mother's fall, in eady September, 2019, I
reported the accident and broken flooring to respondent, NEW YORK CITY
HOUSING AUTHORITY, Ms. Roy the housing assistant in her office at 90
Lenox Avenue, New York, NY.
5. Both my mother and I were not aware of the time limits
necessary to file a Notice of Claim and since my mother's accident she had
left hip surgery and been disabled since.
6. My mother sustained sedous personal injuries including but not
limited to a fractured hip requiring two (2) surgeries to date as a result of her
fal due to the negligence of respondent.
7. No prior application for the relief sought herein has heretofore been
made.
WHEREFORE, it is respectfully requested that the instant reRef be
granted in its entirety, together with such other and further and different relief
,
as to this court may seem just a d proper.
