20 Plaintiff, STEWART TITLE OF SACRAMENTO, INC., alleges as follows:
21 1. Plaintiff is, and at all times herein mentioned was, a corporation, organized and existing
22 under the laws of California, operating in Sacramento and Placer County.
23 2. THERESA J. CREWS, is, upon information and belief, and at all times relevant herein, a
24 resident of Placer County, California.
25 3. JEFFREY M. CREWS, is, upon information and belief, and at all times relevant herein, a
26 resident of Placer County, California.
27 4. ROBERT B. GOLDSMITH, is, upon information and belief, presently a resident of Santa
28 Clara County, California.

1 5. DANIELA GOLDSMITH, is, upon information and belief, presently a resident of Santa
2 Clara County, California.
3 6. Defendants DOES 1 through 20, inclusive, are sued herein under fictitious names. Their
4 true names and capacities are unknown to Plaintiff. When their true names and capacities are ascertained,
5 Plaintiff will amend this Complaint by inserting their true names and capacities herein.
6 7. This action involves the sale of real property located in Placer County at 6580 Oak Hill
7 Drive, Granite Bay, California 95746 ("Subject Property") by THERESA CREWS and JEFF CREWS
8 (collectively "Selling Defendants") to ROBERT GOLDSMITH and DANIELA GOLDSMITH
9 (collectively "Purchasing Defendants").
10 8. On or about August of 2011, the Selling and Purchasing Defendants engaged m
11 negotiations to purchase the Subject Property.
12 9. In the purchase agreement between the Selling and Purchasing Defendants, the parties
13 agreed that an earnest money deposit of $10,000 would remain in escrow until all contingencies outlined
14 in their purchase agreement were satisfied. Attached herein as Exhibit A.
15 10. Since 2011, Selling and Purchasing Defendants have been in dispute regarding the escrow
16 funds, and neither party is willing to resolve the dispute and release the funds. On multiple occasions,
17 Plaintiff Stewart Title has attempted to contact the Defendants to release the funds it has held in escrow.
18 Still, Purchasing Defendant is unwilling to agree to release the $8,975.00 funds in escrow unless it is split
19 evenly in half among the Purchasing and Selling Defendants.
20 11. Failure to agree to the appropriate division of the outstanding $8,975 .00 currently held in
21 escrow has resulted in a dispute between the parties since 2011. Selling Defendants wish to release $2,000
22 of the funds to the Purchasing Defendants while retaining the remaining $6,975.00 of the funds.
23 12. Purchasing Defendant holds firm that the $8,975 held in escrow be split evenly between
24 the parties. Both parties have previously attempted to cancel the transaction, but Purchasing Defendants
25 have failed to agree to the release amount.
26 13. Plaintiff is now in possession of the following property: the amount of $8,975 held in an
27 escrow account pursuant to an agreement between the Defendants entered into in August of 2011. In the
28 relevant part, the Cancellation of the Contract and Release of Deposit, and Joint Escrow Instructions

1 outline disclosures that both the Seller and Buyer acknowledge mutual cancellation of the Agreement and
2 authorize the escrow holder to continue to hold the deposit until they receive subsequent mutual
3 instructions. Attached hereto as Exhibit B.
4 14. Plaintiff prepared and sent multiple emails to the parties asking for mutually signed
5 instructions on disbursing the disputed funds held in escrow. The emails indicated judicial intervention
6 would be necessary for failing to resolve the dispute informally and mutually agreeing to release the
7 current funds held in escrow.
8 15. As of the date of filing the instant complaint, Plaintiff has yet to receive any mutual
9 cancellation instructions regarding the disbursement of the disputed escrow funds. Thus, a current dispute
10 exists between the Defendants concerning these funds and the purchase of the Property. Both Purchasing
11 and Selling Defendants have not taken any further action to cancel the purchase or demand disbursement
12 of these escrow funds.
13 16. Plaintiff has no title to and claims no interest in the funds, except to award Plaintiff its
14 costs, including attorneys' fees, for this interpleader action. Plaintiff does not know which of the
15 Defendants is entitled thereto and cannot safely determine for itself which claim is right and lawful. As a
16 result, Plaintiff seeks to interplead these funds with the Court.
17 17. Concurrently with filing this interpleader action, Plaintiff will deposit the funds with the
18 clerk of this Court pursuant to the Code of Civil Procedure §386(c).
19 18. Plaintiff has incurred costs and reasonable attorneys' fees in an amount to be determined
20 at trial and may incur additional costs and fees hereafter.

21 WHEREFORE, Plaintiff STEWART TITLE OF SACRAMENTO prays judgment as follows:
22 1. That Defendants THERESA CREWS, JEFFREY CREWS, ROBERT GOLDSMITH and
23 DANIELA GOLDSMITH each be ordered to interplead and litigate their claims to the money or property
24 described in the Complaint;
25 2. That Plaintiff be discharged from any liability to each of the said parties with respect to the
26 said money or property; and
27 3. That Plaintiff be awarded costs and reasonable attorney fees to be determined by the Court
28 and to be paid out of the money deposited with the Court; and
