                   PLEASE TAKE NOTICE, that Defendant, LIBERTY COCA-COLA BEVERAGES

         LLC, by their attorneys, Lewis Brisbois Bisgaard & Smith, LLP, hereby demands that Plaintiffs,

         BRIAN VERWOERT, FRED LEDERER and RANDI LEDERER, in accordance with Article 13

         of the Civil Practice Law & Rules, local Court Rules and Case Law, serve within twenty (20) days

         after receipt of this demand, the following:

                   1. Copies of any and all medical records in the possession of plaintiffs and plaintiffs’

                        counsel.

                   PLEASE TAKE NOTICE, that upon failure to produce the aforesaid items at the time

          and place required in this demand, a motion will be made to the Court for the appropriate relief

          with cost.

                   PLEASE TAKE FURTHER NOTICE, that upon your failure to comply herewith, the

          plaintiffs herein will be precluded at the trial of this action from offering any evidence as to the

          plaintiffs’ alleged damages.
