                 PLEASE TAKE NOTICE that on the annexed petition dated October 6,

          2021, GLORIAK CORP. will move this court as follows:

          Return Date:          December 1, 2021, 9:30 a.m.

          Place:          At a motion support office of the Supreme Court of the State
          of New York, County of Nassau, at the courthouse, 100 Supreme Court Drive,
          Mineola NY 11501, for assignment to an IAS Part.

          Supporting Papers Verified petition and exhibits annexed thereto. Memorandum
          of Law.

          Relief Requested An order transferring to the Supreme Court, the action of the
          parties filed in the Nassau District Court, First District, Index No. CV-017154-
          19 and directing the clerk of Nassau District Court, First District to transfer the
          file.

          Grounds              The action was filed in the District Court to recover the
          principal sum of $9360, plus, on the third cause of action, contractual attorney
          fees. petitioner, following discovery, then moved for summary judgment for the
          principal sum of $10,920. Due to defendant’s creative, novel defense, the
          attorney fees plus principal are now way beyond the $15,000 jurisdictional limit

          of the District Court. Contractual attorney fees are generally added to the
          principal sum sought in order to determine the monetary jurisdiction of a court of
          limited jurisdiction.
