NO. 138 132 RECEIVED NYSCEF: 11/17/2023 11/14/2023 Gregory Krull From: Debra Norton Sent: Thursday, November 9, 2023 6:47 PM To: Joe Nicastro; Louis Dingeldey; Gregory Krull; Lent, Thomas M.; Kristine Celeste; Rich Hall Subject: RE: NJS v West Seneca CSD 805265-2020 Counselors, This is a reminder of the Final Settlement Conference scheduled for next week, November 16, 2023 at 1 p.m. We are in receipt of various motions, but do not feel they are an impediment to moving forward with the FSC. Sometimes uncertainty is a good opportunity to get cases settled. Please be advised that the Judge has had the opportunity to review the motion to withdraw filed by Mr. Krull, and that motion is being denied. It is our expectation that the trial, which has already been previously adjourned, will proceed in January as scheduled. As most of you know, our Final Settlement Conferences all take place in person. We ask you to allow two hours, although in this case, we are beginning at 1 p.m., so kindly be prepared in case the session goes longer. The objective of our FSC is to get the case settled. We ask the plaintiff to have the client available by phone, and we ask the defendants to have an adjuster available by phone, where applicable. Inasmuch as two of the parties do not have insurance coverage and have little, if any, personal money to contribute, their attorneys will be excused early, but are asked to appear at 1 p.m. Mr. Lent's carrier made a substantial offer some time ago, which was declined, and under the circumstances, he may appear virtually if he chooses. Thank you for your continuing courtesies and cooperation. Debra Norton, Confidential Law Clerk 1
