Dear Judge Acker:
This office represents the Plaintiff, 323 Wall Street Owners LLC, in the above referenced
action. Please be advised that I have joined the law firm of Whiteman, Osterman & Hanna LLP
("WOH") effective November 1, 2023, and we are in the process of transitioning clients to the new
firm. The Plaintiff, however, has advised that they will not be transitioning this file to WOH, and
would like to replace Lewis & Greer, PC as counsel of record. I understand that another attorney
has agreed to take this case, but requires a 90-day adjournment of the trial currently scheduled to
commence on December 20, 2023, due to other commitments (although I remain cautiously
optimistic that the case will settle prior to trial).
We respectfully request the Court to adjourn the trial for 90 days. If the request is granted,
29th
then we also request the Court to adjourn the pre-trial conference scheduled for November
pending the filing of the consent to change attorney.
