A Case Management Conference was held before the Court on January 24, 2023. By
agreement of the parties, the Court sets the following AMENDED case management
schedule:
Discovery shall be completed by June 2, 2023.
Plaintiff’s expert identification and report due July 7, 2023.
Defendant’s expert identification and report due October 6, 2023.
Dispositive motions and proposed orders shall be filed on or before January 15, 2024.
Responses are due 28 days after dispositive motions are filed. No replies without leave of
Court.
Prior to any motion to compel, the party seeking discovery shall notify the Court by
email to mhom@cpcourt.summitoh.net that a discovery dispute has arisen and what efforts
have been taken to resolve it. All other counsel shall be carbon copied (cc:’d) on the email.
A Final Pretrial is set for April 2, 2024 at 10:00 a.m. All parties, with full authority to
settle, must be present. Counsel shall file any motions in limine no later than March 22,
2024. Lists of trial witnesses and trial exhibits shall be filed with the Court and exchanged
between the parties no later than March 22, 2024.

Each party’s proposed jury instructions and set of agreed jury instructions are to be
provided to the Court before the date of the Final Pretrial by email to mhom@cpcourt.
summitoh.net in Microsoft Word format. Counsel are to exchange jury instructions before
this deadline. Legal support regarding the disputed instructions shall be separately submitted.
A Jury Trial shall be held on May 6, 2024 at 8:30 a.m.
If the attorney of record has a scheduling conflict, then that attorney must find a
colleague to appear on his or her behalf. The chosen representative must have knowledge of
the case and the same authority to participate in the proceedings as the attorney of record, and
have your calendar with the authority to set future pretrial and trial dates, if necessary.
All parties shall provide their current email address on all pleadings.
This case management schedule will not be changed, except on the Court’s own motion.
FAILURE TO ATTEND A COURT APPEARANCE OR FAILURE TO
COMPLY WITH THIS COURT ORDER OR ANY OTHER COURT ORDER SHALL
RESULT IN SANCTIONS, INCLUDING, BUT NOT LIMITED TO, DISMISSAL OR
ADVERSE JUDGMENT.
