The court sets the following case management schedule: TRIAL DATE: July 16, 2024 at 1:00 p.m. FINAL PRETRIAL DATE: June 12, 2024 at 10:00 a.m. All clients with full settlement authority must be present at the final pretrial with trial counsel of record. If an insurance company is involved, a representative with full settlement authority shall attend. MEDIATION shall be completed by June 7, 2024. DISCOVERY shall be completed by February 29, 2024. MOTIONS that the parties wish to file, which are substantive or dispositive, must have written leave of Court. For good cause shown, the parties are hereby granted leave to file Motions for Summary Judgment. To provide for the orderly progression of this case, the following schedule is hereby set: Motion(s) for Summary Judgment due: February 29, 2024 Response(s) to Motion(s) for Summary Judgment due: March 28, 2024 Reply briefs due: April 4, 2024. EVIDENCE AND/OR EXHIBITS that the parties intend to offer at trial shall be identified in a list and provided to the Court ten (10) days prior to trial. A separate photocopy of reproducible exhibits shall be given to the Court at the commencement of trial. This list is separate and apart from any list furnished earlier under Rules of Discovery. Failure to list an item will bar its use at trial. The parties and their counsel are ordered to cooperate in any discovery yet to be completed or allowed. Defendant shall produce expert reports for all non-treating physicians on or before April 18, 2024. Any and all supplemental expert reports shall be produced by May 2, 2024. (Supplemental does not include new expert reports). Expert discovery shall be completed by May 2, 2024. Any party who did not produce an initial expert report will not be permitted to submit a supplemental report. WITNESS LISTS for trial shall be provided to opposing counsel by the final pretrial. Such list is separate and apart from any list furnished earlier under Rules of Discovery. Any witness not on the list shall not be permitted to testify at trial. However, the parties may call rebuttal witnesses whose testimony could not have been reasonably anticipated. Proposed Jury Instructions and Interrogatories are to be provided to the Court in Word format by email to jvance@cpcourt.summitoh.net ten (10) days prior to trial. Motions in Limine, Transcripts of Deposition Testimony to be presented at trial (with objections marked), Stipulations and Trial Briefs shall be filed ten (10) days prior to trial. Courtesy copies shall be provided to the Court. Counsel and/or parties shall fully comply with this order, irrespective of the status of any settlement negotiations or any other considerations. THE PARTIES SHALL COOPERATE AND COMMUNICATE IN ALL ASPECTS OF DISCOVERY. SHOULD THERE BE DISCOVERY DISPUTES, THE PARTIES SHALL CONTACT THE COURT PRIOR TO FILING ANY MOTIONS TO COMPEL OR MOTIONS FOR PROTECTIVE ORDER. IN THE EVENT THAT ANY PARTY FILES A DISCOVERY-RELATED MOTION WITHOUT FIRST CONTACTING THE COURT, THE MOTION WILL BE STRICKEN, SUA SPONTE. FAILURE TO ATTEND A COURT APPEARANCE OR FAILURE TO COMPLY WITH THIS COURT ORDER OR ANY OTHER COURT ORDER SHALL RESULT IN SANCTIONS, INCLUDING BUT NOT LIMITED TO, DISMISSAL OR ADVERSE JUDGMENT.
