Dear Justice Crane:
We write on behalf of Respondents in the above-referenced action to request permission from the
Court to file a Memorandum of Law in support of Respondents’ Motion To Dismiss the New York
Attorney General’s (the “AG’s”) Petition that is longer than the 7,000 word-limit imposed by
22 NYCRR § 202.8.
On June 28, 2023, the AG filed a 300+ page Petition alleging fraudulent and illegal conduct
purportedly committed by Respondents in violation of Executive Law Section 63(12). (Dkt. No. 1.)
In support of its Petition, the AG filed over 64 affidavits, 27 transcripts, and a combined 580 exhibits,
totaling nearly 18,000 pages. (Dkt. Nos. 1-680.) Respondents respectfully submit that responsive
arguments and analyses require more than 7,000 words permitted under the applicable word limit, and
request permission to file their Memorandum of Law containing up to 20,000 words. The AG
consents this request.
