Dear Justice Crane:
We write to advise the Court and the parties of a family relationship between a member of this
Office and a member of the team of Independent Healthcare Monitor David Hoffman. Specifically, after
learning that this Court appointed Mr. Hoffman to serve as the Independent Healthcare Monitor on July
11, Diana Elkind, a Deputy Chief in the Medicaid Fraud Control Unit’s (“MFCU”) Civil Enforcement
Division, advised MFCU management, that Mr. Hoffman is a family friend of her husband’s father and
step-mother, with whom she has interacted socially from time to time in the past. Deputy Chief Elkind
does not work on this matter now, nor has she worked on this matter in the past; nonetheless, in an
abundance of caution, MFCU management instructed Deputy Chief Elkind not to speak with Mr. Hoffman
regarding this matter.
Recently, Deputy Chief Elkind learned that her husband’s step-mother, Ilene Warner-Maron,
works with Mr. Hoffman on the Centers monitorship. Upon learning this, she notified MFCU
management, and a formal screen was implemented pursuant to which Deputy Chief Elkind shall have no
communications regarding this matter with Mr. Hoffman, Mrs. Warner-Maron, or members of MFCU
staff. This screen formalizes the already-existing state of affairs because Deputy Chief Elkind does not,
and has not, performed any work on the Centers litigation or monitorship and has not communicated with
Mr. Hoffman or Mrs. Warner-Maron regarding this matter. Although there is no conflict and Deputy
Chief Elkind remains screened off from the Centers matter, we are nonetheless notifying the Court and
the parties in the interest of transparency.
We thank the Court for its courtesy and consideration and are available to address any concerns
the Court may have.
