On October 26, 2023, the Court considered Plaintiffs' Objections to and Motion to
Exclude the Expert Report and Testimony of Mr. Bryan K. O'Rourke and Brief in
Support (the “Motion”). The Court having reviewed the Motion, any response thereto,
the pleadings and discovery on file with the Court, and the argument of counsel, denies
Plaintiffs’ Motion as MOOT in light of the Court’s ruling on Defendants’ motion to
exclude the testimony and opinions of Plaintiffs' expert Jeffrey G. Matthews.
IT IS THEREFORE ORDERED, ADJUD'GED and DECREED, the Court having
excluded the testimony and opinions to which Mr. O’Rourke was rebutting, the Court
finds Mr. O’Rourke’s rebuttal testimony and opinions are no longer necessary, and Mr.
O'Rourke is precluded from proViding any testimony or opinions at trial.
