KENDALL, Court File No. Steams County Attorney, County Attorney File No. CF -2022-138 Plaintiff, vs. ORDER flied in District Court 2017 KIA Sportage KNDPRCA66H7242240, State of Minnesota Dated Defendant. This matter came on for hearing in the Steams County District Court, before the Honorable Nathaniel Welte, Judge of District Court, on October 7, 2022, for a 96-hour hearing required by Minn. Stat. 609.5312 subd. 4, regarding the forfeiture of 2017 KIA Sportage KNDPRCA66H7242240. Madelyn Tillemans, Assistant Stearns County Attorney appeared on behalf of the State. Also appearing was: Jamie Lynn Becher, on behalf of the defendant 2017 KIA Sportage KNDPRCA66H7242240. Based on all the evidence adduced and all the files, records, and proceedings herein, the Court makes the following Findings: FINDINGS 1. Pursuant to Minn. Stat. § 609.5312, subd. 4, Jamie Lynn Becher received notice of the State's intent to seize and forfeit the defendant vehicle within 48 hours of the seizure. 2. Pursuant to Minn. Stat. § 609.5312, subd. 4, an initial hearing was held within 96 hours of the seizure, in which the State certified Jamie Lynn Becher was charged with fleeing a peace officer while using defendant 2017 KIA Sportage KNDPRCA66H7242240. 3. The owner has failed to demonstrate to the court's satisfaction that the owner has a defense to the forfeiture, including but not limited to the defenses contained in Minn. Stat. § 609.5312, subd. 2. 73—CV-22-8228 4. Seizure of the vehicle does not create an undue hardship for members of the owner's family. ORDER 1. The defendant 2017 KlA Sportage KNDPRCA66H7242240 is to be held by the seizing agency pending resolution of the related criminal charges and the forfeiture proceedings. IT IS SO ORDERED.
