3 Pursuant to California Code of Civil Procedure section 170.6, Plaintiff Gary Koop
4 (“Plaintiff”) hereby moves to disqualify Honorable Christopher M. Honigsberg from presiding over
5 the trial in this case.
6 This challenge is based upon the Declaration of Stacy M. Tucker and is made on the grounds
7 that Honorable Christopher M. Honigsberg is prejudiced against Plaintiff and/or the interests of
8 Plaintiff such that Plaintiff’s counsel believes that its client cannot have a fair and impartial hearing
9 or trial before Honorable Christopher M. Honigsberg.

11 WHEREFORE, pursuant to the provisions of section 170.6 of the Code of Civil Procedure,
12 Plaintiff and its attorneys respectfully request that this Court issue an Order reassigning the trial in
