We have filed an Implied Consent Petition in connection with this matter. Due to the “fast-track” program on DWI cases in Hennepin County, our Implied Consent hearing date will not be scheduled within 60 days of the filing of our petition pursuant to Minn. Stat. $169A.53, Subd. 3(a). Because the hearing date will not be within 60 days, I request that you temporarily reinstate Mr. Ruff's driving privileges and temporarily reinstate his/her vehicle license plates pending the outcome of the criminal case or the Implied Consent hearing. We will waive our right to a hearing within 60 days pursuant to Fedziuk v. Commissioner of Public Safety, 696 N.W.2d 340 (Minn. 2005). I would greatly appreciate it if you would fax me a confirmation as to when Mr. Ruff driving privileges are reinstated. I thank you in advance for your attention to this matter.
