You are receiving this Notice because you have filed an RJI and Notice of Medical, Dental or
Podiatric Malpractice Action or Request for a Preliminary Conference in this action.
*** If a PC Stipulation is not e-filed prior to 10/24/2023, a mandatory in-person conference
will be scheduled***
Submissions will not be accepted by email.
Where all parties can agree upon a discovery schedule, we strongly encourage you to
submit a Preliminary Conference Stipulation and Order for Medical, Dental, and Podiatric
Malpractice Actions to be so ordered. In the event that the preliminary conference
stipulation is submitted at least three (3) business days prior to the scheduled preliminary
conference date and is determined to be acceptable, no appearance at the preliminary
conference will be required.
The Preliminary Conference Stipulation and Order for Medical, Dental, and Podiatric
Malpractice Actions form is available online on the website of the Ninth Judicial District
https://ww2.nycourts.gov/courts/9jd/civilCaseMgmt.shtml .
E-file your stipulation as Preliminary Conference Order (Proposed) to ensure it is received.
The preliminary conference stipulation submitted must be signed by all parties who have
appeared in the action and must strictly comply with 22 NYCRR §202.19 and provide that
all disclosure be completed within 15 months from the filing of the RJI as set forth in 22
NYCRR §202.19. If the preliminary conference stipulation is not submitted, or is not
submitted in a timely basis to allow proper review, the conference shall take place as
scheduled.

The counsel for plaintiff is required to notify all other parties of this conference within two
