It is important that you do not ignore this notice or any court papers that you receive, or YOU MAY LOSE YOUR HOME. Under the law, you are entitled to attend a court conference with your lender to see if the matter can be resolved. The conference shall include settlement discussions regarding the rights and obligations of the parties in this foreclosure proceeding. Your conference has been SCHEDULED for SEPTEMBER 26, 2023 @ 9:30 A.M. in the Foreclosure Settlement Conference Part, 100 Supreme Court Drive, Mineola NY 11501 in the Foreclosure Center, on the LOWER LEVEL. WHAT THE HOMEOWNER SHOULD DO You should arrange to get help as soon as possible. If you have a private attorney, you should notify him/her immediately so the attorney may attend the conference. If you do not have an attorney, you should seek assistance from a counseling organization from the approved list which was sent to you by the bank's attorney. Also, you should be contacted by an approved counseling organization that was notified by the court about your case. The assistance of these agencies is free, and they should not be charging any fee for legal services provided to you. In addition, you now have extra time to file an answer in your case. In the meantime, if you wish to call a free legal service to get help with preparing and filing an answer, please call one of the legal services providers on the list enclosed with this Notice. Further, under CPLR 3408(b), if you appear before the court without an attorney, the Court will screen you for what is known as Poor Person Relief. You do not have to be poor to get this relief. You need to fill out a form to be considered for Poor Person Relief. You may also ask the Court to appoint an attorney to represent you. If the court finds that it is appropriate and if an attorney is available, the court may appoint an attorney to represent you. You may request a Poor Person Relief form from the court or your legal service provider or housing counselor. WHAT YOU MUST BRING WITH YOU * The summons and complaint * The enclosed Settlement Conference Worksheet with your expenses * Current income documentation including paystubs and benefits information * Recent mortgage statements * Property tax statements * Information on your Income tax returns * Rental Agreements or proof of rental income * Any previous applications for loan modifications that you have Please be aware that the court requires this information at the conference. The Plaintiff/lender must have: * A copy of the Note and Mortgage * The payment history and the amounts needed to cure and payoff the loan. * Mortgage Application forms with a description of loss mitigation options available, if any * Any prior documentation, in the event the parties have previously met and tried to work out delinquencies prior to court involvement, along with any denial reasons. * A summary of the status of the lender's or servicing agents evaluation for loan modification programs or other loss mitigation options and a list of any outstanding items required by the borrower to complete the application. * Plaintiff/lender must have an appropriate loan modification application packet available at the conference and have a representative of Plaintiff's loss mitigation department with knowledge and authority concerning this mortgage available by telephone. If the plaintiff is not the owner of the mortgage and note, the plaintiff shall provide the name, address and phone number of the legal owner. A failure by Plaintiff/lender to adhere to the directives of this paragraph may constitute a default, resulting in sanctions or other court action including but not limited to; the ordering of a hold on mortgage payments pending resolution of the litigation.
