The above-entitled matters came on for hearing before the Honorable Daniel C.
Moreno on June 16, 2016 upon Plaintiff's Motion for Summary Judgment. Appearances
were noted on the record.
The Court, based upon Plaintiff's Motion, Affidavits, and all of the pleadings
herein, and having considered the arguments of counsel, and after reviewing all of the
records, files and proceedings herein, makes the following:
FINDINGS OF FACT
A Summons and Complaint giving rise to the present action were duly served
upon Defendant Michael Timmerman on August 4, 2015.
Plaintiff is the assignee of Defendant’s delinquent Citibank NA credit card
account at issue herein.
That Plaintiff's First Set of Interrogatories, Request for Production of Documents,
and-Requests for Admission were served upon Defendant on March 29, 2015.
That Defendant has not responded to the Requests for Admission or other
discovery requests.
Defendant is indebted to Plaintiff in the amount of $29,346.36.
There exist no genuine issues of material fact or law precluding Plaintiff from
summary judgment:

CONCLUSIONS OF LAW
Pursuant to Rule 36 of the Minnesota Rules of Civil Procedure, the subject matter
of Plaintiff's Requests for Admission are deemed admitted.
Pursuant to Rule 56 Minn. R. Civ. Proc., Plaintiff is entitled to summary judgment
for the relief requested in its Complaint against Defendant Michael Timmerman.
ORDER FOR JUDGMENT
Plaintiffs motion for summary judgment is granted.
Judgment shall be entered in favor of Plaintiff and against Defendant Michael
Timmerman in the amount of $29,346.36.
3 That Plaintiff is awarded its costs and disbursements herein.
LET JUDGMENT BE ENTERED ACCORDINGLY.
