22 PLEASE TAKE NOTICE THAT the Honorable Judge of the Superior Court of San
23 Bemardino County has reviewed the Application for Determination of Good Faith Settlement brought
24 by Defendant San Antonio Regional Hospital in accordance with the provisions of Code of Civil
25 Procedure § 877.6(a)(2), and finds said Application to be in order.
26 After full consideration of the evidence offered in support of the application and the application
27 itself, including the points and authorities submitted in support of the application, the declaration of
28 Evelin Duenas, Esq., and the Notice of Settlement, the court finds the following:
[pRoPoseD) ORDER
That the settlement between plaintiff Alexander Ruiz and Defendant San Antonio
Regional Hospital in the amount of Forty-Five Thousand dollars and zero cents
3 ($45,000.00) satisfies all of the relevant elements for a fair and reasonable settlement
and thus has been entered into in good faith.
That any claim against Defendant San Antonio Regional Hospital for equitable
comparative contribution, or total or partial or comparative indemnity, based on
comparative negligence or comparative fault in connection with, or arising out of, this
action are forever barred pursuant to Code of Civil Procedure § 877.6(c).
All provisions of California Code of Civil Procedure § 877.6(a)(2), have been complied
10 with for obtaining a good faith determination of this settlement.
IL IT IS THEREFORE ORDERED, ADJUDGED, AND DECREED THAT: The settlement
12 reached between defendant San Antonio Regional Hospital and plaintiff Alexander Ruiz was made in
13 good faith and any claim against Defendant San Antonio Regional Hospital for equitable comparative
14 contribution, or total or partial or comparative indemnity, based on comparative negligence or
15 comparative fault in connection with, or arising out of, this action are forever barred.
