Petitioners having made an application for an order,
pursuant to CPLR §7510, confirming the award of the arbitrators
and, in support of the application, the Petitioners have
submitted (i) a notice of petition dated August 2, 2023 (NYSCEF
Doc. a petition verified Yisroel Eckstein on the 2nd
#2), (ii) by
day of August, 2023 (NYSCEF Doc. #1), (iii) a copy of the
arbitration agreement dated May 23, 2023, together with a
certified translation dated July 17, 2023 (NYSCEF Doc. #3), (iv)
a copy of the arbitration award dated May 23, 2023, together
with a certified translation dated July 17, 2023 (NYSCEF Doc.
#4), and (v) a copy of the compliance letter dated June 28,
2023, together with a certified translation dated July 17, 2023
(NYSCEF Doc. #5); and the Petitioners having filed affidavits of
service (NYSCEF Doc. #8) and Sheriff Certificates of Service
(NYSCEF Doc. #9 and #10), demonstrating that the Respondents
have been duly served with copies of the above documents; and
Upon the foregoing papers and upon hearing Suslovich &
Klein LLP, attorneys for the Petitioners in support, and the
Respondents not appearing in opposition, it is
ORDERED that the award of the Beis Din Zedek
Rabbinical Court of the Central Rabbinical Congress of the
U.S.A. and Canada, issued by Rabbi Menachem Zecharye Zilber,
Rabbi Abraham Gross, and Rabbi Baruch Arye Leibish Rubin, which
is signed and affirmed the 23rd of is
day May, 2023, hereby
confirmed in all respects, and it is further
ORDERED, that the Kings County Clerk is directed to
enter a judgment in favor of the Petitioners and against the
Respondents, jointly and severally, in the amount of $351,666,
together with interest from May 23, 2023, as well as for the
costs and disbursement of this proceeding.
