             1        I offer this declaration in lieu of personal testimony pursuant to Sections 2009 and
21
     2015.5 of the California Code of Civil Procedure; Rule 1225 of the California Rules of Court;
22
     Reifler v. Superior Court, (1974) 39 Cal. App. 3d 479; and Marriage of Stevenot, (1984) 154
23
     Cal. App. 105.   The facts stated herein are personally known to me and if called as a witness, |
24
     could competently testify to the truthfulness thereto except as to those matters which are stated
25
     on information and belief and as to those matters I believe them to be true.

2         I am an attorney licensed to practice in the state of California.   I am of counsel

     with Funsten & Franzen, the attorneys of record for Petitioner Julia McConaghy in the above

     captioned matter. I have been a member in good standing of the California State Bar since

     November 2001.       My primary areas of practice are trust litigation and probate, estates and trusts,

     and family law.

             3         Tam making this declaration in support of Petitioner’s above captioned Ex Parte

     Application Requesting Orders on Petition for Final Distribution and Waiver of Account.

             4         On or about September 7, 2023, at 4:00 p.m., | noticed Kate Ellen King by
