It is unclear from your letter if you, or someone from your office, first reached out to counsel for the defendant to see if he consents to such request, which this Court expects will occur before any request to adjourn a date is made to the Court. If that has not happened, it must first occur. If you are unable to secure the Defendant’s consent, then the Court is certainly willing to entertain a request to adjourn the motion return dates for good cause shown, provided that the defendant is given an opportunity to be heard concerning the request. The Court notes that prior to uploading the letter request to adjourn the motion return dates, a Court notice was uploaded to NYSCEF by my law clerk indicating that oral argument is not being scheduled, and that the motions will be considered as scheduled, on February 23, 2023, on submission only. Accordingly, to the extent the need for the adjournment is to address the request for oral argument, that issue has already been resolved. If you are nevertheless seeking an adjournment for good cause, then please reach out to Defendant’s counsel and if no consent is granted, write the Court clarifying your reasons/need for the request and any good cause that exists.
