NOTICE AND MOTION FOR PROPOSED DISMISSAL
FOR RECORD INACTIVITY AND NOTICE OF HEARING
It appears from the face of the record that no activity by filing of pleadings, order of court,
or otherwise has occurred for a period of at least ten (10) months; the Court has not issued an
order staying the action; and the Court has not approved a stipulation for stay of the action.
Rule 1.420(e), Fla. R. Civ. P. Therefore, the Court on its own motion will dismiss this action, if
no record activity occurs within sixty (60) days of the date of this Notice.
ACCORDINGLY, it is ORDERED that, unless:
(a) record activity occurs within sixty (60) days of the date of service of this notice,
(this notice does not constitute record activity);
(b) the action is stayed; or
(c) the plaintiff shows good cause IN WRITING at least five (5) days before the
hearing on the motion why the action should remain pending, the Court will dismiss this action
without prejudice. The case Is set for a hearing by video conference on the Court’s motion
on October 10, 2022, at 9:45 a.m. at the Duval County Courthouse, 501 W. Adams Street,
Hearing Room 734, Jacksonville, Florida. Alternatively, if plaintiff files a notice of voluntary
dismissal and provides a courtesy copy to the Court and opposing party, the hearing will be
cancelled. Please do not call the Court’s Judicial Assistant requesting that this hearing
be changed or giving the status of the case. Counsel and parties shall attend the hearing via
Zoom (https://zoom.us) using the information below:
